RETURNS

Returns will be discussed and facilitated on an individual basis, with the prerequisite that the client provide notice via email of the intent to return within 30 days of the date that the work was received. Before the return process can proceed, the client must receive an email acknowledgement indicating that Waterline has received the client’s notice of intent to return, which was timely completed within the 30-day period. All sales are considered absolute and final after the 30-day period has elapsed.

In general and unless otherwise agreed in writing, the client will be responsible for all return costs, which can be substantial. Accordingly, Waterline highly encourages prospective clients to view all product photography and imagery on a desktop computer or screen, rather than relying on a mobile-viewing device. Upon request, Waterline will gladly provide additional photos or any information that may aid in the client’s assessment.

The client maintains ownership of the purchased work until Waterline tenders notice that the work has been received in its original condition and that a refund (less any incurred return costs) has been approved.

SHIPPING

For items purchased directly from Waterline, shipping is complimentary within the continental United States, unless expressly agreed otherwise. Items purchased through other channels (e.g., third-party marketplaces, intermediaries, partner entities, etc.) may incur shipping expenses, unless otherwise agreed upon by Waterline and the client. International shipping - including Alaska, Hawaii, and U.S. territories - can be arranged, but will incur additional costs. If assistance is required to facilitate the shipment of a work outside of the continental U.S., please email info@waterlineart.com prior to placing an order.

Clients are welcome to make their own shipping arrangements, but will be responsible for all expenses incurred through the retention of a third-party shipper. In such instances, Waterline will require a signed form authorizing release of the purchased work to the client’s representative.

Waterline will use the shipping address provided during the checkout process when booking transport. Upon email receipt of a formal invoice, clients should verify that the shipping address on file is correct. After the final destination is confirmed, Waterline will coordinate transport and delivery, the details of which will be communicated to the client of record or designee.

Domestic shipping will be fulfilled by an Interstate Commerce Commission (ICC) approved common carrier such as FedEx or UPS, or in some instances, a dedicated delivery shuttle will be dispatched. For items shipping via common carrier, packing measures that meet or exceed accepted industry practices will be employed in an effort to mitigate against the possibility of damage or loss. Each item in transit will be covered for the full value of the actual purchase price, in the unlikely event that a claim for damage or loss must be filed.

Transport via shuttle will require the client or a designee to be available to accept delivery when the art shuttle passes through the destination area. While Waterline will assist with the entirety of the delivery process, it is the client's responsibility to communicate with the shipping provider to coordinate delivery. If the client will be unavailable to accept delivery during the shipping vendor's estimated delivery timeframe, Waterline highly recommends that the client make alternate arrangements to have the delivery accepted during the proposed window. Many of Waterline's shipping partners only travel to certain regions of the country on an infrequent basis, so a missed delivery window could result in a significant delay in the client receiving the work. If the client confirms delivery with the shipping vendor, but misses the delivery, the client may be responsible for paying an additional delivery fee to have the item rescheduled for a subsequent delivery by the vendor.

Please note that unless otherwise agreed, installation services are not included in the delivery. Waterline would be glad to provide referrals for third-party art installation services, but the client will be responsible for facilitation of such services and all associated fees.

Works shipped via common carrier typically arrive within several weeks. Please be advised that shuttle delivery times can vary significantly, based on the vendor’s schedule and the client's location. In some instances, delivery can take several months to complete.

PAYMENT

Waterline offers secure online payment processing of all major credit cards through the Stripe application. For clients who prefer to remit payment by alternative means, please email info@waterlineart.com to make arrangements. No items will be released until all payments and obligations have been settled.

SALES AND USE TAX

Waterline is registered with the Texas Secretary of State and the Texas State Comptroller, and is legally obligated to collect sales and use tax in the state of Texas at a rate of 8.25 percent. Waterline's platform will automatically add sales tax to any invoice that reflects a shipping destination within the state of Texas. For clients with sales and use tax exempt status in Texas, please contact Waterline prior to purchase, and upon completion of a valid Texas Sales and Use Tax Resale Certificate (Form 01-339), a revised invoice, less sales tax, will be issued.

While orders that ship via ICC-approved common carrier to a destination outside of Texas are not subject to Texas sales and use tax, the client is responsible for assessing whether any applicable taxes should be remitted to the client’s local taxing authority. Waterline disclaims all liability associated with a client’s failure to meet any tax obligations imposed by the client’s domicile.

CONDITION

Waterline provides a basic assessment of condition for each work offered for sale. Such statements are provided solely as a courtesy to prospective clients. Prospective clients understand and accept that condition statements are not and should not be considered the opinion of an art conservation and restoration expert. Waterline endeavors to convey details and defects that are reasonably noticeable under ordinary conditions, but under no circumstance should this informal assessment be deemed comprehensive or otherwise final.

Please note that all offerings are original works of art - typically oils or acrylics on canvas that exceed 50 years of age. None of Waterline's inventory are in pristine condition, with each work showing varying degrees of imperfection and wear, dependent upon the materials employed, the artist's manner of application, and the prior handling of a work.

AUTHENTICITY

Waterline unconditionally guarantees the authenticity of every work sold. When available, detailed provenance will be provided (e.g., from the artist’s estate).

DAMAGED ARTWORK

Waterline takes great care to ensure the safe transport of every work that is shipped to a client. Notwithstanding, in the unlikely event that a purchased work has been damaged during transit, immediately email info@waterlinefineart.com and await further instructions. Preserve all packing materials, which may need to be photographed in the event that an insurance claim is filed. Failure to follow Waterline’s instructions concerning the preparation and submission of a claim for loss could jeopardize the successful processing of the claim, and potentially preclude the client from being compensated for the loss.
